Functions and duties
I. Position and functions
1. The Department of Health is a specialized agency under the Provincial People's Committee with the function of advising and assisting the Provincial People's Committee in state management of health, including: Preventive medicine; medical examination and treatment; rehabilitation; medical examination, forensic medicine, forensic psychiatry; traditional medicine; medical equipment; pharmaceuticals; cosmetics; food safety; health insurance; population - family planning; reproductive health and other health work in the province according to the provisions of law.
2. The Department of Health has legal status, its own seal and account; is subject to the direction and management of the Provincial People's Committee in terms of organization, staffing and operation; and is subject to the direction, guidance, inspection and examination of the expertise and profession of the Ministry of Health.
II. Duties and powers
1. Submit to the Provincial People's Committee:
a) Draft decisions and directives; planning, long-term, 5-year, annual plans; programs, projects, measures to organize the implementation of administrative reform tasks and other documents within the authority of the People's Council and the Provincial People's Committee in the health sector;
b) Draft documents specifying the functions, tasks, powers and organizational structure of the Department of Health;
c) Draft documents specifying the conditions, standards, and titles for the Heads and Deputy Heads of organizations and units under and directly under the Department of Health; Heads and Deputy Heads of Health Departments under the People's Committees of districts, towns, and cities (District-level People's Committees).
2. Submit to the Chairman of the Provincial People's Committee:
a) Draft decisions, individual directives and other documents within the authority of the Chairman of the Provincial People's Committee to issue in the health sector in the province;
b) Draft decisions on the establishment, merger, separation, and dissolution of organizations, agencies, and units under and directly under the Department of Health according to the provisions of law;
c) Draft documents regulating the relationship between the Department of Health and the Departments, branches, sectors, agencies under the province, and the People's Committees at the district level regarding local health work; between the Department of Health and relevant units and organizations regarding health work at the district level;
d) Draft programs and solutions for mobilization and inter-sectoral coordination in disease prevention and control, food safety, population - family planning, and other health work in the province.
3. Advise and organize the implementation of the work of drafting legal documents; Review, systematize, inspect, process legal documents, disseminate and educate the law, monitor the implementation of the law, inspect the implementation of laws, planning, plans, programs and projects on health under the management of the Department of Health in the province according to the provisions of law.
4. Confirm advertising content for special products, goods and services under the state management of the Department of Health according to the provisions of law.
5. Regarding health communication and education:
a) Organize and implement health communication and education work;
b) Act as a focal point for providing information to the press and people about health work in the locality.
6. Regarding preventive medicine:
a) Direct, guide and evaluate the implementation of professional regulations and national technical standards on prevention and control of infectious diseases; HIV/AIDS; prevention and treatment of addiction to opioids; non-communicable diseases; occupational diseases, accidents and injuries; environmental health, school health, hygiene and occupational health; community nutrition; border health quarantine; chemicals, insecticides, disinfectants used in household and medical sectors in the province;
b) Directing and organizing the monitoring of infectious diseases, non-communicable diseases, diseases of unknown cause, early detection and treatment of infectious diseases causing epidemics; implementing epidemic situation notifications according to the provisions of law; advising the Provincial People's Committee on the announcement of epidemics and the end of epidemics according to the provisions of law;
c) Directing and organizing the implementation of vaccination and the use of medical biological products for subjects according to the provisions of law; organizing the reception of dossiers, granting certificates of eligibility for vaccination in the province according to the provisions of law;
d) Issuing, re-issuing, and revoking biosafety certificates for laboratories according to the provisions of law;
d) Act as a focal point for the prevention of tobacco harms, prevention of the harms of alcohol, beer and alcoholic beverage abuse in the province;
e) Standing member of the Provincial Steering Committee for Disease Prevention and Control, HIV/AIDS Prevention and Control.
7. Regarding medical examination, treatment and rehabilitation:
a) Direct, guide and monitor the implementation of legal documents, professional regulations, national technical standards for medical examination, treatment, rehabilitation, medical examination, forensic examination, forensic psychiatric examination facilities according to the management hierarchy and technical hierarchy;
b) Grant, re-grant, suspend, revoke certificates of practice of medical examination and treatment and grant, re-grant, adjust, suspend, revoke operating licenses for medical examination and treatment facilities and facilities for treatment of addiction to opium-like substances with substitute drugs according to the provisions of law;

8. Regarding traditional medicine:

b) Direct, guide, and monitor the implementation of legal documents, professional regulations, and national technical standards for medical examination, treatment, and rehabilitation facilities using traditional medicine and pharmacy in the province according to decentralization;
c) Grant, re-grant, suspend, and revoke certificates of practice of medical examination and treatment using traditional medicine and grant, re-grant, adjust, suspend, and revoke operating licenses for medical examination and treatment facilities using traditional medicine according to the provisions of law.
9. Regarding pharmaceuticals and cosmetics:
a) Guiding the implementation and monitoring of the quality of pharmaceuticals and cosmetics in the province. Directing and monitoring the recall of drugs according to regulations;
b) Directing and implementing the management of drug trading and pharmaceutical practice (granting, suspending, revoking pharmaceutical practice certificates), granting certificates of eligibility for drug trading, and issuing cosmetic declaration numbers in accordance with the provisions of law;
c) Implementing drug price management and drug bidding in accordance with the provisions of law;
d) Directing and guiding the implementation of hospital pharmaceutical work and other tasks in accordance with the assigned authority.
10. Regarding food safety:
a) Presiding over, developing and submitting to competent authorities for promulgation of local technical regulations on food safety for local specific food products in accordance with the provisions of law;
b) Supervise the quality of products and establishments producing and trading food additives, processing aids, containers, packaging materials, bottled drinking water, natural mineral water, functional foods, foods fortified with micronutrients and other foods in the area according to the decentralization of the Ministry of Health;
c) Organize the reception of declarations of conformity or confirmation of declarations of compliance with food safety regulations; issue certificates of establishments meeting food safety conditions, confirm knowledge of food safety for food service establishments, establishments producing and trading food products according to the provisions of law;
d) Manage food safety in the area; manage safety conditions for small-scale food production and trading establishments, street food, food service establishments, food safety at markets in the area and subjects according to the management decentralization;
d) Standing Committee of the Inter-sectoral Steering Committee on food safety at the local level.
11. Regarding medical equipment and facilities:
Guide and evaluate the implementation of legal provisions on medical equipment and facilities.
12. Regarding population - family planning and reproductive health:
a) Organize the implementation of the system of indicators and targets in the field of population - family planning; direct and guide national technical standards, professional and technical processes on reproductive health care and family planning services;
b) Organize the implementation and guide, inspect, supervise and evaluate the implementation of policies, programs, projects, models related to the field of population - family planning and reproductive health care;
c) Decide to allow the implementation of gender reassignment techniques and reproductive support techniques in accordance with the provisions of law;
d) Standing Committee of the Provincial Steering Committee on Population and Family Planning.
13. Regarding health insurance:
Advising, directing and guiding the implementation of policies and laws on health insurance.
14. Regarding health human resource training:
a) Organizing the implementation of plans for training and fostering health human resources and policies on developing health human resources in the province;
b) Managing health human resource training facilities as assigned by the Provincial People's Committee.
15. Assisting the Provincial People's Committee in state management of enterprises, collective economic organizations, and private economic organizations; guiding and inspecting the activities of associations and non-governmental organizations participating in activities in the health sector in the locality according to the provisions of law.
16. Implementing the administrative reform program in the health sector according to the objectives of the state administrative reform program of the Provincial People's Committee.
17. Carry out international cooperation in the health sector as assigned or authorized by the Provincial People's Committee.
18. Be responsible for providing professional guidance on areas under the management of the Department of Health to the Health Departments of the People's Committees of districts, towns and cities.
19. Organize research and application of scientific, technical and technological advances; build information and archive systems to serve state management and professional work in the health sector.
20. Inspect, examine, handle violations and resolve complaints and denunciations, prevent and combat corruption, practice thrift and combat waste in the health sector as prescribed by law and as assigned or authorized.Permit medical examination and treatment facilities to apply new techniques and new methods according to the provisions of law.

22. Manage the organizational apparatus, civil servant payroll, civil servant rank structure, job positions, staff structure according to professional titles and the number of employees in public service units under the Department; implement salary regimes and policies, treatment regimes, training, fostering, commendation and discipline for civil servants, public employees and workers under the management of the Department according to the provisions of law and according to the assignment or authorization of the Provincial People's Committee.
23. Guide and inspect the implementation of the autonomy and self-responsibility mechanism of public service units according to the provisions of law.
24. Manage and be responsible for finance and assets assigned according to the provisions of law and as assigned or authorized by the Provincial People's Committee.
25. Carry out information work, periodically and suddenly report on the implementation of assigned tasks to the Provincial People's Committee and the Ministry of Health.

21.
